Office of the Registrar


The Registrar and Chief Executive Officer of the College, in addition to fulfilling the responsibilities set under the Regulated Health Professions Act, 1991 and the Naturopathy Act, 2007, also:

  • Assists the College Council in its established governance structure;
  • Provides leadership, direction and guidance to the College on governance-related issues;
  • Supports the development and implementation of regulations, by-laws and policies under direction of the Council;
  • Oversees all operational activities of the College;
  • Ensures good management and fiscal practices, including oversight and responsibility for the annual operating, capital and cash budgets.
  • Provides reports to the Ministry of Health and Long-Term Care (MOHLTC) and the Office of the Fairness Commissioner of Ontario on activities of the Council and College.

Legislated Duties of the Registrar

Under the Health Professions Procedural Code (HPPC), the Registrar & CEO also performs the following duties (all numeric references are to the HPPC section numbers):

Registration

  • To issue a certificate of registration as set out in the definition of certificate of registration.
  • To receive applications for registration. The Registrar is only entitled to either register the applicant or refer the application to the Registration Committee (15(1))
    • The applicant must be referred to the Registration Committee if the Registrar has doubts on reasonable grounds about whether the applicant fulfills the registration  requirements.
    • Is of the opinion that Terms, Conditions and/or Limitations (TCL) should be imposed on a certificate and the applicant does not consent.
    • Proposes to refuse the application (15(2)).
  • If the applicant is referred to the Registration Committee, the Registrar must advise the applicant and provide grounds for the referral and that he or she has the right to make written submissions (15(3)).
  • If the Registrar feels that a certificate should be issued with TCL, and the applicant consents, the Registrar may do so with the approval of a panel of the  Registration Committee (15(4)).
  • If the applicant asks for a copy of his or her application file, the Registrar will provide "all information and a copy of each document the College has that is relevant to the application" unless the Registrar feels that in doing so, the safety of any person is in jeopardy (16).
  • To comply with the direction of the Registration Committee to either:
    • Issue a certificate;
    • Issue a certificate if the applicant completes further examinations;
    • Issue a certificate  if the applicant  successfully completes additional training;
    • Impose TCL on a certificate;
    • Refuse to issue a certificate (18(2)).
  • To comply with the direction of the Registration Committee, who will consider applications for variation, and either:
    • Refuse the application;
    • Remove any TCL on a certificate;
    • Modify TCL on a certificate (19(6)).
  • The Registrar may receive a request for  leave to allow a member to re-apply for variation within 6 months of the last application. A leave will only be granted if the Registrar is satisfied that there has been a material change in circumstances. (19(8)).

Register

  • The Registrar is responsible for maintaining the Register (23).
  • The Registrar may refuse to post required information on the Register if he/she has reasonable grounds to believe that the disclosure may jeopardize the safety of an individual or if it is obsolete and no longer relevant. (23(5)(6)).
  • The Registrar will not disclose personal health information on the Register unless it is of the member and it is in the public interest to disclose the information (23(8)).
  • The Registrar will disclose the minimal amount of personal health information as is required (23(9)).

Suspensions/Revocations

  • The Registrar is responsible for administrative suspensions. If a member fails to pay a fee in accordance with the by-laws, the Registrar shall give the member notice of intention to suspend and may suspend if the fee is not paid within 30 days (24).

Complaints and Investigations


  • The Registrar receives complaints. (25(1)) and must provide confirmation of receipt to the complainant and notice to the member (25(5)(6)).
  • The Registrar is responsible for keeping an eye on timelines for complaints. If the ICRC has not disposed of a complaint within 150 days,the Registrar shall provide the complainant with written notice and an expected date of completion which shall be no more than 60 days. If 210 days arrives, the Registrar must provide the complainant and the member with written notice and reasons for the delay and the new expected completion date which shall be no more than 30 days from the date of the revised notice. The Registrar must also advise HPARB. (28(3)(4)).
  • If an appeal is made to HPARB,the Registrar is responsible to provide HPARB a record of the investigation within 15 days of HPARB's request (32(1)).
  • The ICRC can direct the Registrar to suspend or impose TCL on a certificate if an allegation is referred to the Discipline Committee and it is of the opinion that the conduct of the member exposes or is likely to expose his or her patients to harm or injury (37(1)).
  • The Registrar appoints investigators, if:
    • Registrar believes on reasonable and probable grounds, that the member has committed an act of Professional Misconduct or is incompetent, the Registrar will set out his/her reasons to the ICRC and ask for approval. If the ICRC approves, the Registrar is to appoint the investigator (but in an emergency, the Registrar can forego the approval of the ICRC (75(2));
    • The ICRC has received information from the Quality Assurance Committee and has requested the Registrar to conduct a n investigation,  he/she will appoint an investigator;
    • The ICRC has received a complaint and wants an external investigator, the Registrar will appoint an investigator (75(1)).
  • When the investigator completes the Registrar's  investigation, or the ICRC investigation, the Registrar will provide a copy of the Report to the ICRC (79(a)(b)).

Discipline

  • If the Discipline Committee finds that a member has committed an act of professional misconduct or is incompetent it can direct the Registrar to:
    • Revoke the certificate;
    • Suspend the certificate (for a specified period of time);
    • Impose TCL on the certificate for a specified period of time (51(2) and 52(2))3.

Incapacity

  • If the Registrar believes that a member may be incapacitated,the Registrar shall make appropriate inquiries and shall report the results to the ICRC (57).
  • The ICRC can direct the Registrar to suspend the member's certificate if he or she does not agree to a physical or mental examination (59(2)).
  • The ICRC may make an interim order directing the Registrar to suspend or impose TCL on a certificate if:
    • It has referred a matter involving the Fitness to Practice Committee; and
    • It is of the opinion that the physical or mental state of the member exposes or is likely to expose his or her patients to harm or injury (62(1)).
  • If the Fitness to Practice Committee finds that the member is incapacitated , the committee shall direct the Registrar to:
    • Revoke the certificate;
    • Suspend the certificate;
    • Impose TCL (69(1)).

Reinstatement

  • Applications for Reinstatement will be made to the Registrar (72(1). If there was a complainant in the original matter, the Registrar shall provide the complainant with a copy of the application for reinstatement (72(4))4.
  • When the Discipline or Fitness to Practice Committees hears the reinstatement application, they shall provide a copy of its decisions and reasons to the applicant and to the Registrar. (73(6)).

Quality Assurance

  • The Quality Assurance Committee can direct the Registrar to impose a TCL on a certificate, to remove TCL or to disclose the name of the member to the ICRC (80.2(1)). The Registrar is to ensure that the Committee has given the member at least 14 days to make written submissions before any action is taken by the Registrar (80.2(2)).

Other

  • The Registrar is the recipient of mandatory reports (85.1,.2,.3. 85.5, 85.6.1,85.6.2).


All activities of the College and its Registrar & CEO are conducted within the legislated objectives of the College, and with the duty to serve and protect the public interest.
