Consultation: New Regulation about Funding Related to Sexual Abuse
On May 1, 2018 amendments to the Regulated Health Professions Act, 1991 (RHPA) came into effect that made a person eligible for funding for therapy or counselling when a complaint or report is made that they were sexually abused by a Member when they were a patient of that regulated health care professional.
The College is required to have a program in place to fund therapy or counselling for patients who have been sexually abused by naturopaths who are registered to practice in Ontario. This program is overseen and managed by the College’s Patient Relations Committee.
The maximum funding available is equivalent to the amount that OHIP would pay for 200 half-hour sessions of individual outpatient psychotherapy. This amounts to about $16,000 and is available for five years.
Before the May 1 amendments, a person was only eligible for funding after a panel of the Discipline Committee found that the person, while a patient, was sexually abused by a College Member. The changes now allow patients to access funding for therapy as soon as a complaint or report is made alleging that they were sexually abused.The RHPA does not include provisions which would allow the College to cease providing funding to a person unless the maximum of $16,000 or five years has been reached. The College is proposing the introduction of a new regulation about when funding may cease and is seeking input from Members and the public.
The proposed regulation includes two main provisions:
1. The first outlines three situations whereby funding for therapy/counselling may be ceased. These include:
- Where a panel of the Inquiries, Complaints and Reports Committee makes a decision, other than a referral to a disciplinary hearing, with regards to allegations of sexual abuse.
- Where a panel of the Inquiries, Complaints and Reports Committee makes a decision to refer a matter to a disciplinary hearing but the allegations of sexual abuse are withdrawn.
- Where a panel of the Discipline Committee hears a matter and does not make a finding of sexual abuse.
In all three situations the information would be provided to the Patient Relations Committee, which may cease funding or decide that there are special circumstances where funding should be continued.
2. The Second provision outlines that the above three situations will apply to any funding application received by the College as of May 1, 2018.

- The following are the prescribed circumstances upon which payment of funds initiated as a result of s. 85.7(4) of the Health Professions Procedural Code ceases:
- The Inquiries, Complaints and Reports Committee makes a decision pursuant to s. 26(1) paragraphs 2, 3 or 4 and the Patient Relations Committee determines that there are no special circumstances warranting continued funding;
- The Inquiries, Complaints and Reports Committee makes a decision pursuant to s. 26(1) paragraph 1, the allegations of sexual abuse are withdrawn, and the Patient Relations Committee determines that there are no special circumstances warranting continued funding; or
- The Discipline Committee does not make a finding of sexual abuse and the Patient Relations Committee determines that there are no special circumstances warranting continued funding.
- This Regulation shall be deemed to have come into force on May 1, 2018.
